Debt restructuring and liability management

Complementing our securities and banking practice we have a significant experience advising clients on debt restructuring and liability management. We advice companies undergoing financial difficulties on different sectors and industries. We provide legal advice to local and international creditors, debtors and financial advisors. Our clients include companies listed on the local and international stock markets as well as governmental entities. We are also participating in several of the largest debt restructurings currently taking place in Argentina.

CEKD partners and associates are currently working on different debt restructurings which involve, among others, privatized companies, retailers, international utility companies and financial institutions. One of CEKD’s partners, Julio A. Kelly, was a member on behalf of the Ministerio de Economía y Obras y Servicios Públicos of the Board of Settlement of Lawsuits against the National Government. He also played a significant role in the re-negotiation of Argentina’s foreign debt and in the drafting of the Argentine foreign debt to equity swap regime in 1980’.

Our advice includes designing and implementing debt restructuring proposals, representing debtors and creditors in reorganizations and insolvency proceedings, advising in the formation of credit committees, designing and negotiating collateral packages. CEKD’s team participating on large and complex debt restructurings usually includes lawyers with extensive knowledge and expertise on corporate finance, bankruptcy, litigation, and corporate law.
