We provide legal advice to local and foreign companies as well as to governmental entities in connection with the privatization process of national and provincial companies. During the past decade, CEKD’s partners were actively participated in the privatization of some of Argentina’s main public companies. CEKD’s partners have been retained by the Argentine government to draft terms, conditions and bidding documents as well as the by-laws for the privatizations of Yacimientos Petrolíferos Fiscales (YPF - the largest Argentine company in terms of assets and net worth). Our partners also provided legal advice to companies such as Citibank N.A. and British Gas for the privatizations of ENTel (the former state run telecommunication company) and Gas de Estado (former gas distributor in the city of Buenos Aires), respectively.
We have significant experience in administrative law and government regulation. We have developed excellent professional relations with several governmental bodies, including the Banco Central de la República Argentina (Central Bank of Argentina), Ministerio de Economía y Obras y Servicios Públicos (Ministry of Economy and Public Works and Services), Ministerio de Justicia (Ministry of Justice), Comisión Nacional de Valores (National Securities Commission), Procuración del Tesoro de la Nación (Office of the Attorney General), Inspección General de Justicia (Superintendency of Corporations), Comisión Nacional de Comunicaciones (Federal Communications Commission) as well as with provincial agencies throughout Argentina’s 23 provinces.
Additionally, one of CEKD’s partners was a member on behalf of the Ministerio de Economía y Obras y Servicios Públicos of the Board of Settlement of Lawsuits against the National Government. One of CEKD’s partners also played a significant role in the re-negotiation of Argentina’s foreign debt and in the drafting of the Argentine foreign debt to equity swap regime.
